Scope of Agreement

Film Vibes is a searchable video database formed from commercials, documentary and music videos that allow you to find references for your project.

This Agreement, referred to as our general Terms and Conditions, governs your use of the services and technological tools provided by Film Vibes. It applies without any limitations or exclusions. The Agreement remains in effect throughout your usage of Film Vibes or any specific subscription plan that incorporates this Agreement.

This Agreement outlines the permissible use of Film Vibes and the terms and conditions under which Film Vibes grants you access to its technological tools for searching and watching video shots. Additionally, it provides details regarding subscription rates and conditions based on your specific usage requirements of Film Vibes.

By creating an account on filmvibes.io, you are deemed to have fully accepted and acknowledged this Agreement. You can access this Agreement at any time on the Film Vibes website, and it will take precedence over any other versions or conflicting documents. Please note that this Agreement is subject to change at our sole discretion, and we advise you to regularly review it for any updates.

Purpose of the service

At Film Vibes, we curate a vast collection of commercial, documentary and music videos. Our database offers a unique opportunity to explore the creative process and techniques employed by film and video professionals. These videos are carefully selected to serve as valuable resources for your learning, inspiration, research, and as reference points for your professional projects.

By using Film Vibes, you affirm and guarantee that your usage complies with all relevant laws and regulations. The use of Film Vibes is permitted solely for educational and reference purposes. It is prohibited to utilize data, including shots and videos, for entertainment purposes. Any unlawful or prohibited use of Film Vibes or its content may result in the termination or suspension of your account, as outlined in this Agreement.

How to use:

Free plan – Film Vibes offers you a free plan that allows you to make unlimited number of searches and unlimited number of PNG downloads. Free plan also includes 3 GIF or MP4 downloads. To activate the free plan, sign up using the available sign-up options. No card information is required.

Subscription – after using your free MP4 or GIF downloads you can continue making this type of downloads by choosing one of the available subscription plans. Subscription plans provide specific or unlimited (depending on the plan) number of downloads per month/year and unlock features provided by the plan. The duration of your initial subscription will be outlined in your order. Each subscription is intended for use by a single user or the employees of a single company.

Subscription Auto Renewal and Cancelation – unless otherwise specified, your subscription will automatically renew for the shorter of the subscription period or one year. If you choose not to renew, you have the option to cancel your subscription by clicking "Unsubscribe" button in your account settings which you can access by clicking "Menu" button on the upper right corner of filmvibes.io website.

Payment – By enrolling in a monthly or annual plan, you acknowledge and consent to recurring monthly or annual billing commencing from the date of your first payment. Payments are due monthly or annually on the same date or the nearest available date following your initial payment. If any portion of a month or year falls within the subscription term, full payment for that month or year is required. All fees mentioned are exclusive of applicable taxes, which will be charged accordingly. You have the option to temporarily pause billing by canceling your subscription for monthly or annual plans (see Subscription Auto Renewal and Cancelation). If you have chosen to pay by credit card, you grant us authorization to charge your credit card or bank account, or to engage a third-party payment processor, and you consent to the disclosure of your payment details to such third party. It is your responsibility to ensure that your contact information, billing information, and credit card details remain accurate and up to date.

Downgrade for non-payment – In the event of payment delinquency where fees owed to us are overdue by one (1) day or more, we reserve the right to downgrade any fee-based plan to a free plan until the outstanding amounts are settled. This downgrade will entail a reduction in certain features and functionality, and there is a possibility of losing access to the Film Vibes site.

Billing Changes – We reserve the right to modify our fees, including the charges for our plans, at any time. Such changes will be communicated to you through a new pricing structure posted on our website or via email notifications.

Suspension or termination of your account – While you are actively and cooperatively resolving a dispute regarding applicable charges in good faith, we will not suspend your subscription. However, non-compliance with the terms of this Agreement may result in temporary or permanent restrictions, suspensions, or interruptions to your account and/or access to all or parts of the Film Vibes website. These actions are at our sole discretion and may occur at any time, for any reason or no reason, without prior notice, liability, or compensation, including in the event that we discontinue certain aspects of our services.

Refund Policy – by default any amounts paid are non-refundable. However customer satisfaction is always a priority for us, so if you would like to make a refund, please contact us anytime at hi@filmvibes.io and we will review your request.

Limitation of Liability

Liability of Film Vibes towards you can only be invoked for direct prejudice, excluding any indirect prejudice. To the maximum extent permitted by law, Film Vibes shall not be liable for any indirect, incidental, punitive, or consequential damages, or loss of profits, revenue, data, or business opportunities arising from or in connection with this agreement, whether based on contract or tort, and regardless of the theory of liability.

Film Vibes does not guarantee that the Film Vibes website or any content, service, or feature will be free of errors or interruptions, or that any defects will be rectified, or that your use of the Film Vibes website will yield specific results. The Film Vibes website and its content are provided on an "as-is" and "as-available" basis, without any warranties of any kind. All information provided on Film Vibes is subject to change without prior notice. Film Vibes cannot guarantee that any files or data downloaded from the Film Vibes website will be free of viruses, contamination, or destructive features. Film Vibes disclaims all warranties, whether express or implied, including but not limited to accuracy, non-infringement, merchantability, and fitness for a particular purpose. Furthermore, Film Vibes disclaims any and all liability for the actions, omissions, and conduct of third parties in connection with or related to your use of the website and/or any Film Vibes services.

Your use of Film Vibes is solely your responsibility. You agree to indemnify and hold us harmless, upon our first request, and compensate us and our contributors, licensors, content providers, and service providers for any damages, losses, or loss of profits that we or they may incur. This indemnification applies if our liability is incurred by a third party due to actions related to your use of Film Vibes or the distribution, exploitation, or other use of any videos. Furthermore, you are responsible for ensuring that your personnel, including employees and contractors, comply with the terms of this Agreement.

In the event that, despite the provisions outlined in this agreement, Film Vibes or its affiliates are found to be liable to you, Film Vibes's maximum liability to you shall not exceed the total amount you have paid to Film Vibes within the six-month period preceding the event that led to the claim. If you have not made any payments during that time period, you acknowledge that your sole recourse shall be to discontinue using the platform and terminate your account.

The application of certain state laws may override the limitations on implied warranties or the exclusion or limitation of certain damages. If such laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not be applicable in your case.

Services updates

We retain the right to implement changes, updates, or enhancements to our services as we deem necessary. This includes the ability to add or remove features, as well as the option to temporarily suspend or permanently discontinue our services altogether.

Copyrights and trademarks

With the exception of videos, which are owned by the respective third-party copyright holders, you acknowledge and consent that Film Vibes or its licensors retain ownership of all materials present on the Film Vibes website, including the underlying software, related technology, and all associated intellectual property rights.

The content on the Film Vibes website, including but not limited to text, graphics, user interfaces, visual interfaces, photographs, trademarks, artwork, and computer code (referred to as "Content"), is the property of Film Vibes, its licensors, or content providers, and is protected by copyright, patent, and trademark laws. This includes the design, structure, expression, look and feel of the Content. All rights not explicitly granted in this Agreement are reserved by Film Vibes.

Provided that you comply with the terms and conditions of this Agreement, which includes the payment of all applicable fees, Film Vibes grants you a limited, revocable, non-sublicensable, and non-exclusive license to access and utilize Film Vibes for your own educational and reference purposes, as outlined above.

Copyright Dispute Policy

At Film Vibes, we hold a deep respect for intellectual property rights, and we expect the same from our users.

In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Film Vibes will respond expeditiously to claims of copyright infringement committed using the Film Vibes website.

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Film Vibes. Upon receipt of the Notice as described below, Film Vibes will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the filmvibes.io.

DMCA Notice of Alleged Infringement (“Notice”)

• Identify the copyrighted work that you claim has been infringed, or - if multiple copyrighted works are covered by this Notice - you may provide a representative list of the copyrighted works that you claim have been infringed.
• Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, including at a minimum, if applicable, the URL of the link shown on the filmvibes.io where such material may be found.
• Provide your mailing address, telephone number, and, if available, email address.
• Include both of the following statements in the body of the Notice:
  • “I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).”
  • “I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”
• Provide your full legal name and your electronic or physical signature. Deliver this Notice, with all items completed, to Film Vibes:
